Le séminaire de philosophie et droit des données de l'ISJPS, organisé par l'axe données et intelligence artificielle, a une vocation interdisciplinaire et se veut un forum ouvert où les chercheurs viennent partager leur réflexion en cours sur la nature et les enjeux de la “datafication” des activités humaines et de leur environnement.

The ISJPS seminar on the Philosophy and Law of Data is as an open and interdisciplinary forum for researchers to share their current thinking on the nature and challenges of the ‘datafication’ of human activities and their environment.

How Data Became Big: An Intellectual History of ‘Big Data’ as Basis for Artificial Intelligence 1957- 1993

The presentation traces the history of the notion of ‘Big Data’ as it transformed from a problem, mainly present in image processing, to an approach in language processing. I trace what industry actors saw as ‘economic imperatives’ and what military and security agencies saw as ‘imperatives of national security’ that enabled this change. Beyond examining the political economy that enabled this new approach, the paper introduces some of the key algorithms that made the establishment of ‘Big Data’ in language processing possible. The paper moves from language to image processing and points out how algorithms travelled between research laboratories and applications. Therein, tracing the introduction of statistical methods into connectionist models such as neural networks in the late 1980s. This mélange of different approaches provided the basic modelling technologies of AI today. The fact that the methods could be applied across phenomena (language, images) led to the belief, I argue, that they were universally applicable. Finally, I show how new statistical methods led to new forms of evaluation within machine learning, therein changing the epistemological ideals or scientific aims that guided fields such as computational linguistics or computer vision. The presentation argues that this shift in guiding values and goals brought about a new epistemology and discusses the consequences of that epistemological shift. I argue that within current narratives around what we now call ‘Artificial Intelligence,’ large amounts of data appear as the basic building block of what the industry considers ‘intelligence.’ The paper will end by analysing this concept of ‘intelligence’ and discussing the politics or ‘imperatives’ industry CEOs see at work today.

The Fundamental Korean Law on AI Development and the Establishment of a Trust Framework

South Korea became the second country in the world, after the European Union, to adopt comprehensive legislation on artificial intelligence regulation in December 2024. This fundamental law, which will enter into force in January 2026, establishes a global framework including the definition of high-impact AI, the creation of a National AI Committee, and the introduction of mandatory ethical principles.

This presentation will analyze the main provisions of this new Korean legislation and its governance mechanisms. Particular attention will be paid to the various strategies adopted to balance technological innovation and the protection of fundamental rights, as well as the mechanisms put in place to ensure transparency and security of high-impact AI systems. This reflection is part of the international debate on datafication and the regulatory challenges posed by the rapid development of AI technologies.

La Loi Fondamentale Coréenne sur le Développement de l'IA et l'Établissement d'un Cadre de Confiance
La loi fondamentale coréenne sur le développement de l'IA et l'établissement d'une base de confiance La Corée du Sud est devenue en décembre 2024 le deuxième pays au monde, après l'Union européenne, à adopter une législation complète sur la régulation de l'intelligence artificielle. Cette loi fondamentale, qui entrera en vigueur en janvier 2026, établit un cadre global comprenant la définition de l'IA à fort impact, la création d'un Comité national de l'IA, et l'introduction de principes éthiques obligatoires. Cette présentation analysera les principales dispositions de cette nouvelle législation coréenne, ses mécanismes de gouvernance. Une attention particulière sera portée aux différentes stratégies adoptées pour équilibrer l'innovation technologique et la protection des droits fondamentaux, ainsi qu'aux dispositifs mis en place pour assurer la transparence et la sécurité des systèmes d'IA à fort impact. Cette réflexion s'inscrit dans le débat international sur la datafication et les défis réglementaires posés par le développement rapide des technologies d'IA.
